Plaintiffs suing rideshare services for fatal incidents involving suspicious riders may have found some hope for recourse in the state courts last week, after coming up short in recent federal rulings.
A woman whose son was killed during a carjacking while driving for Lyft will be able to pursue her claims against the rideshare service, Judge Robert M. Clayton of the Missouri Court of Appeals ruled on March 4. The ruling differs from recent federal precedent on the liability of rideshare services, such as U.S. District Judge Stephen R. Clark for the Eastern District of Missouri’s November ruling that Uber did not have a responsibility to share information with Lyft about a rider who was a known threat.
