‘You’re Undermining My Authority’: Federal Judge in Hair Relaxer MDL Goes on the Defense


In a contentious debate about how to select bellwether trials in the multidistrict litigation over hair relaxers, defense lawyers threw out a proposal that would allow them to strike certain cases after eight months of discovery.

Then they added a footnote to their brief that made the judge mad: they suggested that, should the judge accept their proposal over that of plaintiffs’ counsel, they would waive their right to have all the cases tried in their original courts.
