“When EPA terminated the grants at issue, it exceeded its statutory authority under § 7438 [of the Clean Air Act] because it cancelled these grants precisely because they are ‘environmental justice’ programs,” U.S. District Judge Adam B. Abelson of the District of Maryland wrote in his decision restoring $180 million of federal Thriving Communities grants to the plaintiffs.
