The U.S. Court of Appeals for the Ninth Circuit overturned an $8 million bench trial award on Wednesday for the company behind the non-fungible token collection Bored Ape Yacht Club, finding that even though Yuga Labs’ “NFTs are not merely monkey business and can be trademarked,” the trial court’s entry of summary judgment was premature against two creators of similar NFTs.
